When an NRI (Non-Resident Indian) wishes to gift a property in India to someone, they typically need the following documents for executing a Gift Deed:

  1. Original Gift Deed Document:
    • The original Gift Deed document, duly executed and signed by the donor (NRI) and the donee (recipient of the gift). The Gift Deed should clearly outline the details of the gift, including the property description, details of the donor and donee, and any conditions or terms associated with the gift.
  2. Proof of Identity and Address of the Donor (NRI):
    • Copy of the donor’s valid passport showing their name, date of birth, photograph, and overseas residential address.
  3. Proof of NRI Status:
    • Documentation proving the NRI status of the donor, such as a valid visa or work permit from the country of residence.
  4. Proof of Identity and Address of the Donee:
    • Copy of the donee’s valid identification document, such as Aadhaar card, passport, or driver’s license, along with proof of address.
  5. Property Documents:
    • Copies of property documents, including the title deed, sale deed, and any other relevant documents establishing ownership of the property being gifted.
  6. Notarization or Apostille:
    • Depending on the requirements of the Indian jurisdiction where the Gift Deed will be used, it may need to be notarized by a notary public or apostilled by the competent authority in the country of execution.
  7. Witnesses:
